Nine Months — Terms of Use

These terms are an agreement between you and Sundar Singh (“we”, “us”) about the Nine Months game. By downloading or playing it, you agree to them. We have tried to write them plainly. If something is unclear, write to us at [email protected].
A game, for fun
Nine Months is a puzzle game for entertainment. Each day it offers a small puzzle, a sticker for your scrapbook and, for each week, a fun fact.
It is for fun, not medical advice. Nothing in the game is medical, health or professional advice. It is not a medical device. It does not monitor, measure, diagnose or predict anything, and the week it shows is worked out from the date you enter, only to choose that week’s puzzles and pictures. Week facts are general and light-hearted, and they are not about you. Please do not rely on the game for any decision about your health.
Using the game
You may download and play Nine Months for your own personal, non-commercial use, on Apple devices you own or control, as Apple’s rules allow.
Apple’s Standard EULA applies too. Your use of the app is also governed by Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These terms add to it. If the two conflict, the Standard EULA wins to the extent of the conflict. Apple is not responsible for the game or its content, and has no obligation to provide support for it.
Nine Months is not directed at children.
Purchases
The daily puzzle, that week’s scrapbook page and that week’s fun fact are free. You can also buy, inside the app:
- The Journey Pass. A single, one-time purchase. It is not a subscription and is never charged again. It opens every week of the journey, past pages of the scrapbook, and extra quiet puzzles.
- Optional extras, such as hint packs and scrapbook themes. A hint pack is used up as you use its hints. A scrapbook theme is a one-time purchase.
All purchases are made through Apple’s App Store and charged by Apple, at the price the App Store shows you before you confirm. Apple’s terms apply to the payment. We never see your payment details.
Refunds are handled by Apple, under Apple’s policies. You can ask Apple for one at reportaproblem.apple.com. We cannot issue refunds ourselves. If Apple refunds a purchase, what it unlocked may be removed.
Restoring. If you reinstall the game or move to a new phone, choose Settings → Restore purchase to bring back the Journey Pass and your other one-time purchases. Hints you have already used are not restored.
Gift codes
You can buy the Journey Pass as a gift (Settings → Give a gift). This gives you a gift code to pass on.
- A gift code can be redeemed once, by one person, in Settings → Redeem a gift code. It then opens the Journey Pass for them.
- A gift code expires two years after it was bought. After that it can no longer be redeemed.
- A gift code has no cash value. It cannot be exchanged for money or refunded by us, and it may not be resold.
- If the gift purchase is refunded, the code stops working, and if it was already redeemed, the Journey Pass it opened is removed.
- Keep your code safe. Anyone who has it can redeem it.
Keeping a copy safe (optional)
The game works fully without an account. If you choose to turn on Keep a copy safe, you sign in with Apple so your scrapbook can be brought back on a new phone. Your copy is encrypted on your phone before it leaves, and we cannot read it. The Privacy Policy explains how this works.
We take care to keep this service running, but it is a convenience, and we cannot promise it will always be available or that a copy can always be brought back. You can turn it off at any time in Settings, which deletes the copy from our server.
Your content
Your journal entries, scrapbook and progress are yours. They stay on your phone unless you choose to share a scrapbook page or keep a copy safe, and we do not claim any rights in them.
Fair use
Please do not:
- copy, sell, rent or redistribute the game or its content, except for sharing your own scrapbook pages as the game allows;
- reverse engineer, decompile or modify the game, except where the law allows it regardless of these terms;
- try to guess, generate, collect or trade gift codes, or get around how purchases are checked;
- interfere with, overload or try to get unauthorised access to our servers;
- use the game in a way that breaks the law.
We may stop providing a service, such as cloud save or gift redemption, to anyone who breaks these rules.
Our content
The game’s illustrations, stickers, puzzles, words, fun facts, sounds and design, and the name Nine Months, belong to us or to those who licensed them to us, and are protected by copyright and other laws. These terms give you a licence to enjoy them in the game. They do not transfer ownership.
You are welcome to share scrapbook pages you made in the game with friends and family, using the game’s share feature.
Changes and availability
We update the game from time to time, including adding new weeks, puzzles and illustrations, and fixing problems. The daily puzzle is designed to work without an internet connection, but purchases, gift codes and cloud save need one.
We may change features, or stop offering the game or part of it. If we do, we will try to give reasonable notice where we can.
We may update these terms. When we do, we will change the date at the top of this page. If a change matters, we will try to let you know in the game. Continuing to play after a change means you accept the updated terms.
Stopping
You can stop playing at any time. Settings → Pause my journey lets you pause notifications, hide the week number and countdown, or delete everything. Deleting your game data does not cancel or refund a purchase, which stays in your Apple purchase history.
Disclaimer
We work hard to make Nine Months gentle, reliable and correct, but we provide it “as is” and “as available”, to the extent the law allows. We do not promise that it will always be available, free of errors, or suitable for any particular purpose beyond being a game.
Nothing in these terms takes away rights you have by law as a consumer that cannot be excluded or limited by agreement.
Limits on our liability
To the extent the law allows:
- we are not liable for losses that were not reasonably foreseeable, or for indirect losses such as loss of data or of opportunity;
- our total liability to you for any claim about the game is limited to the amount you paid for it and its in-app purchases in the twelve months before the claim.
Nothing in these terms limits or excludes any liability that cannot be limited or excluded by law, such as liability for fraud or for negligence where the law does not allow it to be limited.
Your legal rights
Nothing in these terms takes away the protection of the mandatory consumer laws of the country where you live, and you may be able to bring a claim in your local courts.
If any part of these terms is found to be unenforceable, the rest still applies.
